Disclaimer and Acknowledgement

Iowa Wall Sawing, Inc. ("IWS") provides concrete lifting by injecting structural polyurethane foam underneath sunken concrete ("Polylift").

  1. WAIVER
    In consideration of IWS performing Polylift, Customer, for themselves, their heirs, personal representatives or assigns, do hereby release, waive, discharge, and covenant not to sue IWS, its officers, employees, and agents from liability from any and all claims including the negligence of IWS, its officers, employees and agents, resulting in personal injury, accidents, or illnesses and property loss arising from, but not limited to, use of the Polylift, and the following:
    1. RE-SETTLING
      Lifted concrete may resettle at any time following the work performed by IWS, and IWS makes no guarantee as to the length of time the concrete will remain lifted. Notwithstanding the foregoing, IWS does guarantee no settling of the lifted concrete for a limited period of thirty (30) days from the date of the work performed.
    2. DAMAGE TO CONCRETE
      Lifting concrete may cause the existing concrete to crack or fracture, and IWS makes no guarantee as to cracking or fracturing of the lifted concrete or concrete adjacent thereto.
    3. NON-LIFT
      In some cases concrete cannot be lifted due to a number of different factors. In these instances, Customer remains liable for costs of services and materials provided to Customer by IWS.
    4. EXCESSIVE MATERIAL REQUIRED
      In some Non-Lift cases and others involving extensive voids or cavities in the subsoil underneath the concrete, additional material will be required to fill said void or cavity in attempt to lift or actual lifting of the concrete. In the event excessive material is required to fill the void, Customer remains responsible for costs of additional materials provided by IWS upon approval of the Customer to proceed with procurement and installation of additional materials.
  2. COLLECTIONS
    If IWS is required to resort to collection proceedings to recover any amounts from Customer, IWS shall be entitled to recover any and all collection costs, including but not limited to attorneys' fees incurred.
